Australian Consumer Law — Statutory Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.
Definitions
"Buyer" means the person or entity to whom the quotation or invoice is addressed. "Quote" means any quotation issued by PlumbCheck Group Pty Ltd. "Site" means the location where works are performed. "Company" means PlumbCheck Group Pty Ltd and/or its contractors, agents or employees.
Payment
Pricing Basis
All work is performed on a flat-rate price basis unless otherwise specified in the Quote. The price includes labour, materials and GST. An itemised breakdown will not be provided more than 30 days after the initial invoice is issued.
Payment Due Date
All payments are due upon completion of accepted works (C.O.D.) unless otherwise agreed in writing. Failure to pay within two (2) days of the due date constitutes a material breach. The Company may then terminate work, cease services, and pursue all remedies available at law including recovery of all labour, materials, overheads and anticipated profit.
Interest on Overdue Amounts
Overdue amounts will accrue interest at 10% per month plus an administration fee of $25.00 per month until paid in full.
Progress Payments
For any works above $200, minimum progress payments are required at the following stages:
All custom-order goods must be paid in full before works commence on site.
Credit Card Surcharge
A surcharge of 1.5% applies to all credit card payments.
Variations
Any change to the agreed scope constitutes a variation. A written quote is provided before the variation commences; the Buyer must accept within five (5) days. Where emergency works are required to prevent injury or property damage, the Company may proceed without prior approval and will provide documentation and pricing within 24 hours.
No Deductions
The Buyer may not deduct any amount from payments due, including for liquidated damages, penalties, set-off or counterclaim, unless agreed in writing by the Company in advance.
Security Interest
The Buyer consents to the Company lodging and maintaining a Caveat over the property in support of the Company's security interest for all amounts due under this agreement.
Notice of Defective Work
Upon completion, the Buyer must inspect the works with due diligence and notify the Company in writing of any alleged defects within 48 hours of completion. The Company has the right to be the first to repair any alleged defect. Failure to provide this opportunity voids all express warranties. The Buyer must not withhold payment pending a defect dispute, nor engage a third party to remedy Company works without prior written consent — doing so voids all warranties for those works.
Warranty
Workmanship
Warranty on workmanship is provided in accordance with the applicable legislation in the state where works are performed, including the Domestic Building Contracts Act 1995 (Vic) and equivalent legislation in QLD, SA and WA.
Drain Relining
CIPP drain relining works carry a 50-year structural liner warranty against manufacturing defects, issued in writing on completion.
Warranty Claims
Warranty claims must be submitted in writing. An initial service call fee applies and is refunded in full if the issue is confirmed as warranty work. Standard metropolitan service charges for non-warranty calls are set out below. Works outside the metropolitan area attract additional travel charges.

Warranty response is available Monday to Friday, 8:00am–3:00pm, excluding public holidays.
Warranty Exclusions
Warranties do not cover faults caused by misuse, negligence, acts of God, third-party interference or pre-existing defects not reasonably identifiable by visual inspection. Manufacturer-warranted materials are subject only to the manufacturer's warranty. No warranty applies to drain cleaning works unless expressly stated in the Quote. All warranties are void if any payment remains outstanding and are non-transferable.
Return of Defective Goods
Defective goods must be notified within seven (7) days of receipt, returned undamaged within 14 days with prior written approval, and in the same condition as supplied. The Company will, at its discretion, replace or refund. Non-defective goods returned at the Buyer's request incur a 20% handling charge and 30% restocking fee plus freight costs.

Payment for reports may be requested in advance. The Buyer remains the primary contact with their insurer, body corporate or authority at all times. The Company does not guarantee the outcome of any insurance claim — the decision to approve, partially approve or decline rests solely with the insurer.
Cancellation
A standard call-out and assessment fee applies if a booked job is not cancelled at least 24 hours before the technician's scheduled arrival. Fees for non-refundable custom materials and delivery also apply. Deposits paid prior to cancellation are forfeited as liquidated damages. If the Buyer instructs works to cease mid-job, all costs to that point plus make-safe costs are immediately payable.
Limitation of Liability
This clause does not limit any right or remedy available to you under the Australian Consumer Law.
To the extent permitted by law, the Company's liability is strictly limited to re-performing the works outlined in the Quote. The Company is not liable for any consequential, indirect, special or economic loss, including loss of income, profits or business interruption, except where caused by the Company's sole negligence or wilful misconduct.
Drain Cleaning
No warranty is provided on drain cleaning unless expressly stated in the Quote. The removal of root growth or blockages alone does not guarantee the problem will not recur. The Buyer accepts sole responsibility for any cost if drain cleaning equipment becomes stuck in a drainage line. In the event of a sewage spill, including one deemed hazardous, all clean-up costs are the Buyer's sole responsibility.
Electronic Locating
Electronic locating is not always accurate and may generate false readings. The Company is held harmless from any claim, loss or damage resulting from this procedure. Any located line will be verified by manual excavation only before works commence.
After-Hours Material Supply
After-hours orders are subject to stock availability confirmed by a supply coordinator before dispatch. Payment is required in full before dispatch. A 10% surcharge applies to after-hours orders (6:00pm–4:00am Mon–Sat); Sunday and public holiday orders carry double rates on both products and delivery. Delivery: $210.00 incl. GST within the first four hours; $420.00 incl. GST thereafter. Products are intended for use by licensed plumbers only. Opened resin or hardener cannot be returned; unopened, undamaged sleeves may be returned within seven days with prior written approval.
Site Conditions, Access & Unforeseen Works
The Buyer must obtain all required consents (including body corporate or strata), provide safe and legal site access, remove obstructions, and supply electricity and water within 30 metres of the site before commencement. Extermination of pests is solely the Buyer's responsibility. Pipe routing is at the Company's discretion unless otherwise specified.
If unforeseen physical conditions (rock, clay, hazardous materials, unexpected service lines) are encountered, the Buyer accepts responsibility for additional reasonable costs. Hot works may trigger fire alarms — the Buyer is responsible for notifying authorities and for any resulting call-out fees. The Company does not perform asbestos or hazardous material removal.
Promotions & Discounts
By engaging the Company, the Buyer consents to receiving promotional emails and may withdraw this consent at any time. Discount offers apply to goods and services only, not to call-out fees. Only one discount may be applied per invoice.
Subcontractors & Licensing
The Company may engage licensed subcontractors for any part of the contracted works. The Buyer consents to relevant information being shared with subcontractors for this purpose. PlumbCheck Group holds all required licences, including Victorian Building Authority (VBA) registration across all trade classifications and Energy Safe Victoria (ESV) registration for Type A and Type B gas fitting. Certificates of Compliance are issued for all notifiable works.
Dispute Resolution
Disputes must be notified in writing. The parties agree to attempt resolution with a mutually agreed third party before escalating to formal proceedings. If resolution cannot be reached, either party may refer the matter to the relevant state body (Victoria: VCAT; Queensland: QBCC; South Australia: CBS; Western Australia: Building and Energy). The Buyer is liable for all reasonable costs incurred by the Company in pursuing recovery of outstanding amounts, including legal fees. These Terms are governed by the laws of the state where the works are performed.
Privacy
The handling of personal information is governed by our Privacy Policy, which forms part of these Terms.
General
These Terms, together with the accepted Quote and Privacy Policy, constitute the entire agreement between the parties. If any provision is found unenforceable, the remaining provisions continue in force. The applicable law is that of the state or territory where the works are carried out. The Company may update these Terms; the current version is always available at plumbcheckgroup.com/legal/terms.
